قتل يعنی كشتن یا گرفتن جان يك انسان. از زمانی كه جامعه بشری شكل گرفت جرم قتل نيز به وجود آمده و همیشه جرم بوده است. موضوع جرم قتل انسان زنده است به عبارت دیگر انسان زنده ای که مورد حمایت قانون میباشد. بنابراین کشتن حیوانات قتل محسوب نخواهد شد.
به طور كلی قتل به دو دسته «عمد» و «غيرعمد» (خطايی) تقسيم می شود که البته در کشور ما نوع سومی كه به آن «قتل شبه عمد» گفته مي شود نيز وجود دارد.
اگر بخواهیم تفاوت قتل عمد و غیرعمد را بگوییم در قتل عمد قاتل با هدف قبلی قصد كشتن مقتول (فردی که کشته شده است) را دارد اما در قتل غير عمد، قاتل هدف قبلی برای کشتن ندارد و بر اساس سهل انگاری موجب از بين رفتن انسانی می شود.

در صورتی كه مقتول زن و قاتل مرد باشد برای اجرای قصاص مرد باید تفاضل دیه یعنی نصف دیه را به ورثه قاتل پرداخت.
یعنی اینكه برای اجرای حكم قصاص و اعلام یك مرد قاتل، باید نصف دیه از سوی اولیاء دم مقتوله (زن) به قاتل پرداخت گردد. ولی اگر زنی مردی را بكشد قصاص می‌شود و اولیای مقتول جز خون زن مستحق چیز دیگری نیستند.

ولی دم میتواند به میزانی که خودش تعیین می‌کند، در ازای گذشت از خون فرزندش دیه طلب کند. این مبلغ میتواند بیشتر یا کمتر از دیه کامل فرد مسلمان باشد. با دریافت دیه قصاص از محکوم ساقط می‌شود.
دخالت مدعی العموم و اظهارنظر در بعضی موارد نیز میتواند موجب ساقط شدن حکم قصاص شود و این در صورتی است که مجنی علیه ولی نداشته باشد و یا شناخته نشود و یا به او دسترسی نباشد که در این صورت ولی دم او ولی امر مسلمین است و رئیس قوه قضایه با اجازه از ولی امر و تفویض اختیار به دادستان‌های مربوطه نسبت به تعقیب مجرم و تقاضای قصاص یا دیه حسب مورد اقدام می‌نماید.
